This statement comes from a misinterpretation of the tax code by tax protesters. The tax codes state something to the effect of: "…..for the purposes of this section, the term states includes the District of Columbia…".
What Congress meant was that "state" meant all 50 states plus the District of Columbia. Tax Protesters believe that in means only the District of Columbia. Many people have tried this theory in court and none have been victorious.
And….about Bill Conklin. He is a 2-bit scam artist. He offers $100k to people but proclaims himself sole arbiter of who is right or wrong.
The 861 arguments seems to have fallen out of favor with tax protesters. One of the main proponents of this argument, Larken Rose, went to prison a couple of years ago.
File your returns and pay your taxes. You will be much happier in the long run. Tax Protesters always end up broke and alone.

Oh let me start by saying bravo!!! In fact, you should just allow me permission to say that I have always felt that the ENTIRE country should follow this suit exactly, I have two other valuable issues that you could add to your list if you are interested, email me and I will put a couple of cents worth in your brain to think about. I was just thinking about this subject and talk of it daily to my husband and a few friends about how many issues legalization would solve. I joked with a group of friends that I have single handedly solved all the worlds problems using only my brain and marijuana and my trampoline in the back yard after the kide were tucked away in thier beds. I am very interested in putting together a bill someday that will actually be taken seriously since I'm just a mom of three from a little town in Oklahoma. I believe I just need some partnership to point the way and tell me to "go get it done!"
I think the benefits would outweigh the risks and am working towards that goal and your letter is put together in a very friendly matter of fact tone that needs to be read by members of the U.S. Senate and Congress and attached to that bill they are trying to push through so fast, and say "here let this pay for it so the taxpayers will at least be getting something in return for footing the bill for this mess"….well anyway you have inspired me and I appreciate it!! I just watched this link below and googled "the marijuana answer" and clicked on your question that was returned in the search….how interesting is that? It's the pot, it gives me psychic powers…I'm just kidding, I look forward to hearing back though.
This is a civil matter, not a criminal matter. You need to file a small claims type of action in your state if you want any remedy at at. I don't know if NY has a small claims statute so you may have to take it to the municipal court. I recommend that you do this case "In Pro Per" meaning that you represent yourself rather than spend money on an attorney because these people will never come out to NY to defend themselves on such a small matter and you can win by default if you do this properly. You can get great books from No lo Press about representing yourself in court which will walk you through the process A-Z. You will need to perfect service on them and you can do this by highering a professional service company who do cross border service or you can have a third party send service via registered mail to them and this is also find.
Good luck but this is going no where criminally and it will stay civil. I hope that you win and that you feel better in the end when all of this is over with.
Yes… the only reason it was outlawed was so FDR and his propagandists could make the mayor of New York look bad. New York had the highest consumption of any city in the nation. And that was because the mayor of New York once called FDR a sorry excuse for a man.
Later it was found out the in two cases the whole debate was centered on the perpetrators had extensive histories of mental illness. Smoking pot didn't cause them to murder it was schizophrenia. A later study proved all the data the FDR crony came up with was total bull.
By the way the first person arrested under the marijuana tax act of 1937 was an honest hemp farmer. He wanted to pay the tax, the feds showed up and busted him for possession of marijuana without the required stamps. Of course the government never intended on issuing any stamps.
Catch 22 here, you can't get the stamps unless you have the pot, you can't legally possess the pot without the stamps. Poor honest farmer got 4 years and was fined 1000 dollars.
